Tonight’s activity  is one that should strike all of us in the heart.  The Master Singers are performing a Veteran’s Day Concert held at 7:00pm in the Heritage Center (105 N 100 E, Cedar City). Admission is FREE. For more information call 435-865-1072. A special moment of honor is to be given to those who served during the Korean War.

There is quite a lot going on today first off this morning there is another in the Family Hiking Series: Let’s Move! Activity 3 – Bike Race meet at 9:00 am at the Three Peaks Recreation Area large red pavilion. Bring your racing wheels out to Three Peaks to get active! Come enjoy the trails that Three Peaks has to offer, as you race to the finish! Before you leave make sure to grab your prize for finishing the race! For something a little different and fun enjoy Scottish Storytelling with PETER SNOW, a storyteller from Scotland, will be sharing a collection of stories from his book “The Shifty Lad” at 11:00am Braun Books (25 N. Main St., Cedar City). Great for adults and older children, although everyone is invited to attend.

Craving is hosting; LOVE CREATURE held at 8:00pm featuring Karyn Whittemore at Cravings (1180 Sage Drive, Cedar City). Admission is $5.00 or $3.00 for students.

And finally, at SUU the Theatre & Dance Series: ‘I Love You, You’re Perfect, Now Change’ held at 7:30pm in the Auditorium Theatre (SUU Campus, 351 W University Blvd, Cedar City) Southern Utah University Department of Theatre Arts & Dance subscription series. There will be a fund raiser for the St. Judes’s Children’s Hospital tonight at Chili’s Restaurant. All profits will be donated to the St. Jude’s Children Hospital. As you know the St. Jude’s Children’s Hospital does some great things with Childhood Cancer patients. This is a great cause, so take that special person to dinner at Chili’s!

There will also be Free Prescription Assistance from 3 to 5 PM at the Care and Share. Call (435) 865-8520 for more information.

Options Available to You After the Notice of Default

Unfortunately in the Cedar City Real Estate Market there are many people who find themselves in a no win situation with their mortgage company.  While it is hard to accept, it can be a reality.  There are some things that you may be able to do to get out from under the mortgage on your home.  I am talking about not keeping the home.  Here are some of things you can opt to do:

Sell the house:  This seems overly simplistic, but the reality is that some people find themselves in a position where they cannot afford to make their mortgage payment, but are not upside down in their mortgage.  There may be equity in the home, but you just can’t afford to make the mortgage payment.

Selling is by far and away the best option.  There may not be enough equity to refinance to an affordable payment, or you may have gotten transferred to a new place for work.  Selling the home is the best option.

Assumption:  If your mortgage allows it, you may be able to find a borrower that is willing to assume your mortgage and mortgage payment.  The new borrower would have to qualify with the mortgage company, and again, many mortgage companies do NOT allow for this option.  Check with your mortgage company at the earliest possible time to see if this will be allowed.

Deed in Lieu of Foreclosure:  Some mortgage companies will allow you to surrender the house back to the mortgage company instead of completing the foreclosure process.  Most mortgage companies will require that your home be listed for sale for at least 90 days before they will accept the Deed in Lieu of foreclosure.  This solution may also have tax ramifications for the homeowner.  You will want to contact your tax advisor to assess your tax liability on this solution.

Short Sale:  Simply put, this is selling the house for less than is owed on it. This will require approval from the mortgage company as well.  The mortgage company will require that they approve the sales price and conditions of the purchase contract.  This process can really be difficult if there is more than one mortgage on the property.  Contact a local Realtor for a complete explanation of the process of a short sale.  Here in Cedar City, you can contact either Darcy or me, we will be happy to answer your questions about Short Sales.

Foreclosure:  This occurs usually 90 days after you receive a Notice of Default from your mortgage company.  The mortgage company exercises their rights to sell the home.  I have written another blog that goes into the timelines and process of foreclosure.

Bankruptcy:  This is a process that will require you to use an attorney.  It is a serious solution, so talk to an attorney prior to considering this option.

It is our advice that you talk to attorney prior to considering any of these steps.  Many attorneys will do a free consultation with you, be upfront when you make an appointment, tell them what you want to talk to them about and make sure that it is still will be a free consultation.

As with the Short Sale Option, we are happy to talk to you and explain any of the solutions that I have mentioned here in this post.  We are NOT attorneys or accountants, so we can not advise you in those issues, but we are happy to explain the process to you.

The 50th season of the Utah Shakespeare festival gets underway today.  There is so much going on that I am just going to put a link  up for the performances and ticket information.  http://www.bard.org

The Anatomy of a Play Exhibit will take place at the Iron County Visitors Center 581 North Main Street.  (435) 586-5124.  On display will be costumes, set designs and other things that go into making a successful play.

The Shakespeare First Folio Exhibit will be at the Gerald R. Sherratt Library on the Southern Utah University Campus.  On display will be a rare 1623 first edition of Shakespeare’s plays.  11 AM to 7 PM Monday through Saturday.

Garth Brooks had a song in the 1990’s that is a perfect introduction to today’s event.

Tonight and tomorrow at the Iron Rangers Arena come and enjoy PRCA/WPRCA rodeo.  It starts at 8 PM both nights the cost is $10 for Adults and $5 for Children.  Come on out and enjoy the fun!

The Utah Summer Games also continues.  Again check http://www.utahsummergames.org for a schedule of events.

The Archaeological excavation continues in New Harmony, so if you don’t wish to channel Ty Murray, there is Indiana Jones!  The dig is a mile West of Interstate 15 off of Exit 42.  Public tours are available from 10 AM to 2 PM.  If you want to volunteer with the excavation, contact Karen Platt at (435) 867-8422.

There is a rumor that Cedar Breaks National Monument will Open this weekend as well.

The Cedar Faire Flea Market is open from 9 AM to 9 PM.  The Flea Market is located at 1552 West 200 North in Cedar City.

The Southwest Utah Public Health Department is continuing the free immunization clinic.  You need to call for an appointment at (435) 586-2437.  The Health Department is located at 260 East D L Sargent Drive in Cedar City.

The Loaves and Fishes Soup Kitchen  is having a free lunch from 11:30 AM to 1:30 PM.  Located behind the First Baptist Church at 324 West 200 North in Cedar City.

For those civic minded individuals in Enoch and Cedar City, City Council Meetings will be at 5:30 PM for Cedar City and 6 PM in Enoch.  Both will be at their respective City Halls.

The Utah Summer Games continue with some of the early events.  The official Opening Ceremony is Thursday, but the games themselves have been going on for several days.  Check out http://www.utahsummergames.org

The Art exhibits continue at the Frontier Homestead State Park.  Today however, you can drop the children off for Story time while you look at the art.  From 12:30 to 1 PM, it is free to attend.  You then can enjoy some time to see the exhibits or look at the art that is on display!

Kanarraville Town is inviting you to celebrate Memorial Day with the Kanarraville Historical Society.  This will take place at 6:30 PM at the Town Hall.  Admission tickets are by donation.  Town Hall is at 45 South Main Street, please use the East Entrance.  There will be a buffet and an open microphone.

It is also the last day to donate to the Alabama relief effort.  The trailer is at Walmart, and will be leaving to take the supplies to Alabama on Sunday.
